Montana Innocence Project Seeks New Trial for Client

Montana Innocence Project

filed a petition for post-conviction relief Thursday for their client Katie Irene Garding, who was convicted in 2011 and sentenced to 40 years in prison for the vehicular homicide of 25-year-old Bronson Parsons in 2008.

Parsons was walking along a highway with his roommate during the early morning hours of New Year’s Day when a car swerved and fatally struck him.

The case went unsolved for two years until James Bordeaux, Garding’s former boyfriend, told police that Garding “hit someone or something” with her car that morning after drinking all night. For his testimony, Bordeaux received a suspended sentence on a burglary charge.

The Montana Innocence Project presented new evidence in the petition, including crash reconstruction, physical testing performed by experts and computer remodeling, along with expert testimony from six experts and companies.

“No reasonable juror, court, prosecutor or judicial fact-finder could find Garding guilty of the offense in light of the new and powerful evidence,” the petition read.
