Edward Green was charged with rape and assault with intent to rape, stemming from separate incidents in 1987. Both crimes happened in the same location. Green was picked up in the area after the second victim fled from the perpetrator and went to the police. He was acquitted of assault with intent to rape at trial.

The evidence against Green included separate identifications and serology showing that his blood type was consistent with the perpetrator's. The first victim identified Green from a photo array and from an in-person lineup. The second victim identified Green in a show-up procedure. Both victims identified him in court.

Green's attorneys obtained DNA testing prior to his sentencing. DNA testing on spermatozoa left on an item of the rape victim's clothing excluded Green as the source. A motion for a new trial was granted in March 1990 and the indictment was subsequently dropped.
